Understanding the Ways to End a Marriage
There is no truly easy way to end a marriage, but there may be a "best" legal solution for you given the unique circumstances of your life and family. There are many issues to take into account: Are children involved? What about assets including real estate, stock portfolios or pension plans? Will this matter be highly contested? At the Mesaros & Pierson in Centerville, Ohio, we have more than 25 years of experience in helping clients sort out the issues and making choices. The process of making the right choice for you can start with a phone call to 937-528-1779 to schedule a confidential consultation with skilled marital law attorney David Mesaros.
Divorce, Dissolution or Legal Separation?
Choosing the best legal solution for you will depend on your family dynamics, the complexity of your financial situation, and even your personality. Dissolving a marriage may mean:
- Legal separation — In a legal separation you are still married at the conclusion of the case, but you have a court order that defines the responsibilities and rights of each spouse while they are living apart. Legal separation frequently, but not necessarily, leads to divorce or dissolution of a marriage.
- Dissolution — This is a more cooperative and private approach to legally ending a marriage. In dissolution, both spouses must agree to all parts of the contract. It has the advantage of being less costly, both financially and, often, emotionally, since the spouses work together in the process and fault does not have to be found. It can often be completed in about 90 days.
- Divorce — This process can be civil and focus on problem solving or the stereotypical "fight about everything" type of case. The Court is more heavily involved in this procedure and all of the proceedings are more formal and controlled. Methods exist to require a spouse to disclose assets, debts and property. Additionally, child custody and visitation are more closely scrutinized.
